Shocking Video of Ernest Duenez Jr.'s Police Killing Released
At a recent press conference, family members released the footage.
During a press conference several days ago, family members of Ernest Duenez, Jr. released the dash cam video of the police shooting which claimed his life in the summer of 2011. The video was released to the public just after the local DA's office ruled the police shooting 'justified' and the family moved ahead with a wrongful death lawsuit. The police shooting has lead to ongoing protests against the department. These demonstrations have even led the Manteca Police to issue a restraining order against one of the protesters, Gabe Duenez, in an effort to hinder popular community outrage on behalf of Ernest.
In the short video that was just released, Manteca Police Office John Moody is seen responding to call and racing up to a residential street. He then comes up to the car with a gun drawn ordering the person inside to come out. A man emerges and places his hands up, only to trip on his car seat belt. As he falls the police officer opens fire on him, shooting Ernest a total of 13 times, in both the chest and the face. Duenez was then handcuffed as he bled to death, as Moody 'secured the scene,' mainly looking for anything that resembled a knife or other weapon that could be used to justify the shooting.

This action by police of shooting an unarmed suspect, only to then handcuff them when they clearly need drastic and immediate medical treatment is perhaps the most disgusting aspects of the entire case. Like Oscar Grant, who was shot and killed on New Years Day, 2009, on a BART platform outside of Oakland, CA, Ernest was shot and killed by a police officer and then essentially left to die without any direct medical attention. While paramedics did eventual arrive on the scene, this was only after he was handcuffed and has suffered major injury. It is almost a full 7 minutes between the time that Ernest is shot until paramedics arrive on the scene and give aid to him. During that entire time, as the video shows, police instead busy themselves with handcuffing Duenez, removing his clothes, and checking the scene for items of interest. Police in San Francisco similarly shot and killed Kenneth Harding, Jr., after he ran away from transit police for evading a fare on a MUNI bus. After police shot him, they stood over his body as he bled to death, keeping an ever growing hostile crowd from rushing them and taking Harding to proper medical care.
MUNI buses were disrupted after police shot and killed Kenneth for the crime of not paying a bus fare.
But a day after the video of Ernest's death was put up, it was quickly taken down, with a message that read that due to the 'graphic nature of the footage,' youtube could not show it. While the video has once again been uploaded by others and has now since gone viral and has been seen for hundreds of thousands of people and been posted on a variety of blogs, forums, and news sites, it's important to keep in mind that the police are very afraid of this footage reaching a wide audience. It is also possible that police and other's within the government have pushed youtube to remove the footage. After the initial shooting death of Oscar Grant, police attempted to take camera phones away from those that filmed the murder. Police and BART officials also begged people to not post their footage online, although it was only after this footage was posted up that the media even began to cover the story or portray it in a light that was critical to the police. In the summer of 2011 after police shot and killed a homeless man, BART even attempted to shut down wireless internet along the train lines in an attempt to stop protests of the police killing.
It's clear that the police don't want us to see this footage, but it's also clear that they don't want us to get angry while viewing it. Watching Ernest being shot and left to bleed to death in a drive-way handcuffed, it's impossible to do that. And it is that anger that we feel that we must channel, direct, and get organized with.

This policeman was waiting to kill him, saying harasses you leave your vehicle, seen in the video that fits with the seat belt, then does not give first aid, is seen in the video that the police asked his co -worker a knife, which he cuts all over his shirt, and then put it in the back of the truck
The cop wanted him dead, he was waiting for him to show up and he then yelled out " i will shoot you ernest" He knew the suspect and this was clearly pre meditated murder!!!!
Cant say I really blame the cop 4 shooting but 13 times!? He is a trained professional he could have shot and disarmed the man or shot to wound not kill. And it seems like he didnt find any weapon after all.
I think this is disgusting. The cop appears as though he is parked and waiting for the victim. He clealy knew him and wanted him dead. He leaps from the patrol car and says I will shoot you Ernie. My prayers are with the family and I pray justice will be served.
He is clearly saying his name and appears agitated...and what is the protocol for tampering...He cut his shirt off like a deer making sure to rip it in shreds...Was this to destroy evidence of how many times he was shot? This was disturbing and reminds me of the case of Charal RaRa Thomas in Ft. Worth. We protested this in DC with family members of slain victims. We will organize another one in front of the Department of Justice to demand that they look at the increased incidence of police homicides. En la lucha conjuntos...z

This is incorrect reporting. The cop pulls up to the truck, you can see someone crawling around to the passenger side as the cop is approaching he holsters his gun, then Duenez puts one hand on top of the car door and the other on top of the roof of the car, Moody draws his weapon, Duenez reaches down into the vehicle and Moody opens fire.
The cop cut off his shirt because that's how first aid is administered, they waited a long time to call the paramedics. This is obviously overkill.
Also, two cops got a restraining order against his brother Gabriel after Gabriel took pictures of one the cop's kids at a theme park. He's allowed to protest out front the police station.
Duenez isn't armed when he exists. Police are now claiming that Duenez somehow had the knife in his had and then threw it in the back of the truck as he was being shot.
Being that the meeting between Gabe and the police officer randomly met at an amusement park and the judge upheld this as stalking (police take pictures all the time of protesters), I fail to see how this is not intended to act as way to discourage people from organizing.

Absolutely ludicrous !!! He says " I'm looking for the knife he had" but then in less than 1 minute , he asks the other cop for a knife !!! That was cold blooded , premeditated MURDER !! He should be fired ! There are a FEW cops who really want to help society but the majority are psychos looking for a license to kill and beat people on a daily basis!!! WOw, THis is the most sick video I ever saw. the way officer wouldn't help save this life and went out of there way to make sure he didn't live is most unbelievable. yeah he got shot cause wouldn't listen to orders but after 3 shots then they were shooting for fun and to kill. then the way they treated the dead body cutting shirt off, stalling the help from getting to man to revive him. it felt like I was watch something from WWII and gas chambers. The officer JM shouldn't be in the public wearing a gun ever again. and what idiot would justified this should lose his or her job. at the least there should be some prison time for most involved... poor man lost his life for nothing what a waste. I will never visit town again that for sure....

I was very appalledd by this entire video/incident. I've watched/reviewed this video several time & tho it's possible this man may have not been complying w/all of the officer's instructions/commands I never say any actions(by-the-man)that in-any-way could be considered to be life-threating to the officer or anyone else... Henceforth the officer over-reacted when he opened fire & ultimately killed this man. Also it-is-painfully obvious that no one(police officers)ever bothered to administer any kinda medical attention to save this man's life or even let him die at rest. Instead they flung his body from his chest down to on-his-back repeatedly, I thought he even moaned som during the first few turns of his body. Now as to,"How on Earth", this cop ever got a justifiable shooting/no charges filled is amazing, heck he probably didn't even get any kinda departmental reprimand in his file. The reason for this, atleast partially, can be that if this shooting was found unjustified it would put into question all cases this officer has been involved in & that in-turn could reopen cases, be grounds for re-trials, & even acquittals on other cases. In essentially causing any enormous cost, work-load, & extreme embarrassment for the police & more-so the district attorney's ofc. of this area. They'd probably do just about anything to prevent that from happening, including letting an Extemely Unjustified shooting/killing of an unarmed man go unpunished as you have in this case. It has been said before that,"History is written by the victors, not the losers." I guess since this man was in-fact killed that pretty much only leaves one side to tell the story & beings they have alkaline/the-power to boot they can claim/say whatever they want w/o much opposition.....
